GOP Lawmakers Sue Biden Admin Over Proposed Changes to Title IX

Six Republican attorneys general have filed a lawsuit against the Biden administration over proposed changes to Title IX.

That suit, filed on Tuesday, becomes the fourth one that was filed in a two-day span over the proposed revisions to act, which provides protection against discrimination.

The suit that was filed on Tuesday was led by Tennessee and Kentucky. It claims that the proposed expansions to sexual assault rules on college campuses overstep the authority that the president has.

Nine other states filed a similar lawsuit on Monday, contesting protections that are included for transgender students.

The changes proposed to Title IX by the Biden administration would, for the first time ever, expand protections under the law to students who identify as LGBTQ. It does so by adding protections against discrimination that’s based on gender identity or sexual orientation, two things that were added on top of sex.

According to the suit, those changes would override laws at the state level that regulate bathrooms and locker rooms in schools, while also potentially putting young women in some danger.

In a statement, Jonathan Skrmetti, the Republican attorney general of Tennessee, said:

“The U.S. Department of Education has no authority to let boys into girls’ locker rooms. In the decades since its adoption, Title IX has been universally understood to protect the privacy and safety of women in private spaces like locker rooms and bathrooms.

“Federal bureaucrats have no power to rewrite laws passed by the people’s elected representatives, and I expect the courts will put a stop to this unconstitutional power grab.”

The other three suits were filed by Louisiana, Texas and Alabama. All of them make claims that are similar to this week’s in regard to the proposed Title IX changes.

Over the last few years, gender issues on school campuses have become a very divisive issue, and these lawsuits only serve to expand that even more.

In a separate statement, Austin Knudsen, the Republican attorney general of Montana, said:

“For 50 years Title IX has protected girls and women’s rights, but President Biden has abandoned those protections to appease the woke left. This rule is not based in scientific reality. It redefines biological sex, which will allow men to compete in women’s sports, violate women’s privacy, and put women and girls in dangerous situations on campus.”

According to Texas Governor Gregg Abbott, public universities in his state won’t follow the Title IX changes if the courts uphold them. On Monday, the firebrand governor said these changes are a “ham-handed effort to impose a leftist belief into Title IX.”

Abbott, who has repeatedly and publicly clashed with the Biden administration in the last few years, wrote a letter to Biden that read:

“You have rewritten Title IX to force schools to treat boys as if they are girls and to accept every student’s self-declared gender identity.”

Many states that are led by Republican governments have passed laws that prevent transgender students from using locker rooms and restrooms in schools unless they match the gender they were assigned at birth.

Students and teachers are also required in some of those states to disregard how a transgender person wants to be referred, in regard to their pronouns and name.
