Tillis Sets a January 6 Litmus Test for Blanche

Senator Thom Tillis appeared on CNN in April 2026 and drew a hard line on the attorney general nomination. “I won’t support any nominee who thought that any element of January 6th was excused,” Tillis said, adding that his support for a nominee ends “the moment I hear they said one thing that excused the events of January the 6th.” The statement put acting Attorney General Todd Blanche squarely in the crosshairs of Tillis’s self-imposed standard.

Tillis doubled down on that position in subsequent interviews and press statements, making clear his January 6 threshold was a firm “circuit breaker” — his word — for any nominee to lead the Department of Justice. Blanche, who served as Trump’s personal defense attorney before being named acting attorney general, now must satisfy Tillis’s demand or watch his confirmation stall in committee.

One Senator’s Veto Power Over a Cabinet Seat

The math in the Senate Judiciary Committee gives Tillis unusual leverage. Republicans hold only a slim majority on the panel, meaning that if Democrats vote as a bloc against Blanche, a single Republican defection can deadlock the committee and prevent the nomination from advancing to the full Senate. Tillis has demonstrated he is willing to use that leverage — he previously blocked Kevin Warsh, Trump’s Federal Reserve pick, and singlehandedly tanked Ed Martin’s nomination as U.S. attorney for Washington, D.C., over similar concerns.

Tillis’s track record of using confirmation votes as bargaining chips has made him one of the most disruptive figures in the Republican caucus from Trump’s perspective. Trump responded by threatening to recruit a primary challenger against Tillis, a threat that ultimately contributed to Tillis announcing he would not seek reelection. Freed from electoral accountability, Tillis now has little political incentive to stand down on the Blanche nomination.

A Political Fight Dressed as a Principled Stand

Conservative voters have good reason to view Tillis’s maneuver with skepticism. His demand is not rooted in any statutory qualification for attorney general — it is a political confirmation criterion he invented and is enforcing unilaterally. Many January 6 defendants were nonviolent protesters who received sentences that, by any honest measure, far exceeded what the underlying conduct warranted. Demanding that a cabinet nominee formally condemn those individuals is less a principled stand than a political performance aimed at distancing Tillis from the Trump base on his way out the door.

Should Blanche’s confirmation stall in committee, Trump does retain a fallback option. Reports indicate the president could keep Blanche serving in an acting capacity atop the Department of Justice even if the Senate confirmation process does not move forward. That path would sidestep Tillis’s veto entirely, though it would leave the nation’s top law enforcement post in a prolonged state of limbo — a consequence that falls squarely on Tillis’s shoulders.
